Intra Company Transfer

The nonimmigrant visa category was established as a useful tool for international companies needing to bring foreign employees to the United States to work for a limited period of time. The maximum initial period of stay is three years and may be extended up to 7 years.

Provided the company is very successful and employs higher level employees i.e. in a managerial capacity, it is possible to obtain a Green Card without undergoing the Labor Certification process.

The main condition are

1. In the foreign country, the company must be an existing company doing substantial business
2. The employee must have worked at least one year
3. The company must have several employees
4. The company must have been paying taxes
5. In the creation of a company in the United States
6. The transfer of funds into a bank in the U.S.
7. The employee transferred must have been working with the company out of the U.S. at least one (1) year within the past three (3) years
